INFORMATION COMMISSION IN INDIA

The Information Commission is an independent statutory authority established under the Right to Information Act, 2005 (RTI Act) to ensure citizens' right to access information held by public authorities.

1. Types of Information Commissions
There are two levels:

Central Information Commission (CIC) – deals with matters relating to Central Government public authorities.
State Information Commission (SIC) – deals with matters relating to State Government public authorities.

2. Central Information Commission
The CIC was established under Section 12 of the RTI Act, 2005.
It consists of:
Chief Information Commissioner
Information Commissioners, as provided by the Act.

They are appointed by the President of India on the recommendation of a committee consisting of:

Prime Minister – Chairperson
Leader of Opposition in the Lok Sabha
A Union Cabinet Minister nominated by the Prime Minister

3. State Information Commission
The SIC is established under Section 15 of the RTI Act, 2005.
It consists of:

State Chief Information Commissioner
State Information Commissioners
They are appointed by the Governor of the State on the recommendation of a committee consisting of:

Chief Minister – Chairperson
Leader of Opposition in the Legislative Assembly
A Cabinet Minister nominated by the Chief Minister

4. Major Functions
The Information Commission:
Hears appeals and complaints under the RTI Act.

Ensures that public authorities comply with the RTI Act.

Can order disclosure of information where legally appropriate.

Can inquire into complaints regarding denial or improper handling of information requests.

Can impose penalties on Public Information Officers (PIOs) for certain violations of the RTI Act.

Promotes transparency and accountability in public administration.

5. Importance
The Information Commission helps to:
Promote transparency → Reduce secrecy → Prevent misuse of authority → Increase accountability → Strengthen democracy
